1. Agreement to Terms

By using the services provided by Dixie Networks LLC ("Dixie Networks," "we," "us," or "our"), you ("customer," "you," or "client") agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.

2. Services Provided

Dixie Networks provides web hosting, managed IT services, server management, and related technical services. The specific services included in your plan are described on our website and in your service agreement. We reserve the right to modify or discontinue any service with reasonable notice.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate and current contact information. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree not to use our services for any of the following:

Violations may result in immediate suspension or termination of your account without refund.

5. Payment Terms

Service fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). Invoices are due upon receipt. We accept payment via PayPal. Accounts with unpaid invoices more than 7 days past due may be suspended. Accounts more than 30 days past due may be terminated.

7. Service Level Agreement (SLA)

Dixie Networks strives to maintain 99.9% uptime for hosting services. We are not liable for downtime caused by factors outside our reasonable control, including but not limited to natural disasters, network provider outages, upstream carrier issues, scheduled maintenance, or customer-caused problems.

8. Backups and Data Loss

You are responsible for maintaining your own backups of all data stored on our servers. While Dixie Networks may provide backup services as part of your plan, we are not liable for any loss of data, regardless of cause. We recommend maintaining off-site backups of all critical data.

9. Account Cancellation

You may cancel your service at any time by submitting a cancellation request through your client portal or by contacting . Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods. You must back up your data before cancellation, as account data is permanently deleted within 7 days of cancellation.

10. Limitation of Liability

Dixie Networks is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, loss of profits, loss of data, or loss of business, arising from the use of or inability to use our services. Our total liability for any claim shall not exceed the amount you paid for services in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Dixie Networks LLC, its officers, employees, and agents from any claim, demand, or damage arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

12. Privacy

Your use of our services is also governed by our Privacy Policy.

13. Changes to Terms

Dixie Networks reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated to customers via email or client portal notification. Continued use of our services after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the State of Arizona, USA. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
